End-User Consumer License Agreement
This End-User Consumer License Agreement (“Agreement”) governs the terms and conditions under which Photos of Bendigo licenses images to private customers for personal use. By purchasing and downloading photos from the www.bendigo.photos website, you agree to comply with the terms and conditions outlined in this Agreement.
Terminology
Private Customers: Individual people who intend to use photos for personal use only and are not businesses or group entities.
Your Images: Images that you have purchased with a receipt. Images depicting your likeness are not your property to use unless you have purchased a license.
Summary
Private Customers who purchase images from Photos of Bendigo do so with the intent to use photos for their own personal usage. By purchasing images, you acknowledge and agree to the following terms:
No Accreditation Required: Private Customers do not need to provide accreditation when using photos purchased from Photos of Bendigo.
No Release Forms Provided: Photos purchased from Photos of Bendigo do not come with release forms for people seen in the image. Private Customers use photos at their own risk for using someone else’s likeness in the image.
Limited Usage Right: Private Customers have a limited usage right to share and print photos for personal use only.
No Responsibility Assumed: Photos of Bendigo does not take responsibility for how Private Customers may use the photos.
No Resale or Redistribution: Private Customers are not allowed to resell or redistribute photos to third parties.
No Commercial Usage: Photos purchased from Photos of Bendigo are for personal use only and cannot be used for commercial purposes.
Acceptable Usage
Private Customers may use purchased images in the following ways:
Websites, Social Media, and Online Presence: Photos can be used on personal websites, Facebook pages, or social media accounts without crediting Photos of Bendigo.
Printed, Physical Copies: Digital copies of photos can be printed for personal use, such as printing glossy photos, ordering personalized products, or framing photos for display in your own home.
Limited Business/Organization Usage: Private Customers may purchase images on behalf of someone for personal usage. In some cases, businesses or organizations may use purchased images for promotional purposes if they possess the required release forms and consent of their own employees.
Unacceptable Usage
Photos of Bendigo does not allow the following:
